Federal Court Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since his release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to face human smuggling allegations, he was held in federal custody.
In her order, the court noted that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."
